City taxpayers in 2001 reimbursed City Councilman Miguel Martinez for all this spending and more, $27,506 in all, under the public campaign financing system. But the city’s Campaign Finance Board announced Thursday that it was imposing one of the stiffest penalties in its history against Mr. Martinez, because he cannot show that he actually spent the money.

The board fined the councilman $44,780 and ordered him to repay $128,786 he received in matching funds for the 2001 campaign. In the decision, the board said documents from the Martinez campaign were fabricated after the election and submitted to “induce the board to accept them as valid documentation” to avoid repaying any of the matching funds.

“If these were genuine expenditures, the campaign was unable to produce documents that showed it,” said Eric Friedman, a spokesman for the board. “Nor were the vendors. And they didn’t come back to us with records that were convincing to the board.”

The penalties were issued jointly against Mr. Martinez, his campaign committee and its treasurer, Placido Rodriguez.....

In 2006, Mr. Martinez was fined $31,820 for misrepresenting the source of contributions in his 2003 campaign, according to the board.
